1. Acceptance of Terms

By purchasing, downloading, installing, or using ByTamer AI Expert Advisor ("the Software," "EA," "Product"), you ("User," "Customer," "You") agree to be bound by these Terms of Service ("Terms," "Agreement"). If you do not agree to these Terms, do not purchase or use the Software.

These Terms constitute a legally binding agreement between you and ByTamer ("Company," "We," "Us," "Our"). By using our Software, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions

• "Software" refers to the ByTamer AI Expert Advisor, including all files, documentation, updates, and related materials.
• "License" refers to the right to use the Software according to the purchased package terms.
• "Trading Account" refers to your MetaTrader 5 brokerage account where the EA is installed.
• "Authorized Accounts" refers to the number of trading accounts permitted under your license.
• "Updates" refers to bug fixes, improvements, and new versions of the Software.

3. License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the Software on the number of trading accounts specified in your purchased package
• Receive free updates and improvements during the license period
• Access customer support according to your package level

License Packages:

• Starter License: 2 trading accounts, 6 months support
• Professional License: 5 trading accounts, 12 months support
• Enterprise License: Unlimited trading accounts, lifetime support

The license is granted for personal or business use only. The license is tied to the trading account numbers registered during activation.

4. Use Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, lease, sublicense, or transfer the Software
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the Software on more accounts than authorized by your license
• Share your license with third parties or allow unauthorized access
• Use the Software for any illegal or unauthorized purpose
• Attempt to circumvent any licensing restrictions or security measures
• Use the Software to manipulate markets or engage in fraudulent activities
• Resell, redistribute, or commercially exploit the Software

Violation of these restrictions will result in immediate termination of your license without refund.

5. Risk Disclosure

You acknowledge and agree that:

• Past performance is not indicative of future results. Any trading results, testimonials, or examples shown are not guarantees of future performance.
• You may lose more than your initial investment. Trading on margin means you could lose more money than you deposited.
• Markets are unpredictable. Economic events, news, technical failures, and other factors can cause rapid and significant losses.
• Automated trading carries additional risks. Software errors, connectivity issues, broker problems, and unexpected market conditions can result in losses.
• No trading system is perfect. All trading systems, including this EA, have limitations and will experience losing trades.
• You are solely responsible for your trading decisions. You must evaluate whether trading is appropriate for your financial situation.

Specific EA Risks:

• The EA may malfunction due to software bugs, updates, or compatibility issues
• Internet connectivity problems may prevent proper trade execution
• Broker server issues may cause slippage, requotes, or failed orders
• Market gaps and extreme volatility may cause stop losses to be executed at worse prices
• The EA's performance may vary significantly between different brokers
• VPS failures may result in missed trades or improper position management
• Parameter settings may not be optimal for all market conditions

6. No Financial Advice

The Company explicitly states that:

• We do NOT provide investment advice, financial advice, trading advice, or any other form of advice
• We are NOT a registered investment advisor, broker-dealer, or financial planner
• The Software is a tool that executes trades based on technical algorithms, not financial recommendations
• All trading decisions are made by the Software's algorithm and executed automatically
• You should consult with a qualified financial advisor before engaging in trading activities
• Nothing in our website, documentation, or communications constitutes financial advice

Any information, results, testimonials, or examples provided are for educational and informational purposes only. They should not be construed as advice to buy or sell any financial instrument.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

7.1 No Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 No Guarantee of Results

WE DO NOT WARRANT THAT:

• The Software will generate profits or prevent losses
• The Software will perform consistently in all market conditions
• The Software will be error-free, uninterrupted, or secure
• Any results, accuracy, or reliability will be achieved
• The Software will meet your specific requirements or expectations

7.3 Exclusion of Damages

IN NO EVENT SHALL BYTAMER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any trading losses, regardless of the cause
• Any damages resulting from Software malfunction, errors, or bugs
• Any damages resulting from unauthorized access or use
• Any damages resulting from broker actions or inactions
• Any damages resulting from market conditions or economic events
• Any damages exceeding the amount you paid for the Software

7.4 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

7.5 Acknowledgment

YOU ACKNOWLEDGE THAT:

• You are solely responsible for any trading losses you incur
• You use the Software entirely at your own risk
• The Company is not responsible for any actions taken by your broker
• You have been advised of the risks involved in trading
• You are trading with risk capital you can afford to lose

8. Indemnification

You agree to indemnify, defend, and hold harmless ByTamer, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your violation of these Terms
• Your use or misuse of the Software
• Your trading activities and any resulting losses
• Your violation of any third-party rights
• Any claims made by third parties related to your use of the Software

9. Refund Policy

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED.

Due to the digital nature of the Software and the immediate delivery of license keys, we do not offer refunds under any circumstances. By purchasing the Software, you acknowledge and accept this no-refund policy.

Reasons for No Refund Policy:

• The Software is a digital product that cannot be "returned"
• License keys are delivered immediately upon payment
• Trading results depend on many factors beyond our control
• The Software may be copied before a refund request

We encourage you to thoroughly review all information, documentation, and testimonials before making a purchase decision.

10. Termination

We may terminate or suspend your license immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of license restrictions
• Fraudulent or illegal activity
• Abuse of support services
• Chargeback or payment dispute

Upon termination, your right to use the Software will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law provisions.

Dispute Resolution:

• Any disputes shall first be attempted to be resolved through good-faith negotiation
• If negotiation fails, disputes shall be resolved through binding arbitration
• You waive any right to participate in class action lawsuits
• Each party shall bear their own costs and attorneys' fees

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Software after any changes constitutes acceptance of the new Terms.
